The state has denied torturing Mohammud Hussein Aden, a suspect in the attempted murder case of former Garissa Finance Executive Idris Muktar.
In an affidavit, the prosecution claims that the preliminary medical report dated September 5, 2018 does not disclose any signs of torture and inhumane treatment during the period of arrest and detention.
“The applicant allegations of torture and inhuman treatment is an afterthought geared to subvert the course of justice bearing in mind the victim of the investigations is in critical condition fighting for his life,’’ reads the affidavit.
In a preliminary medical report produced before the court from Kenyatta National Hospital, the doctor examined that Mohammud Hussein Aden has a fair general condition, not pale, not dehydrated and walking.
Hussein had alleged that he was taken to a Mabati house where he alleges that he was assaulted by a metallic rod and torch that has electric shock and kicked.
He complained of headache and one episode of vomiting among other issues.
According to the report signed by Dr. Amina Guleid the suspect was discharged on oral medication.
Two days ago Aden claimed that he was treated in an “inhuman, degrading and cruel manner” in a bid to make him sign confessions regarding the alleged attempted murder.
Deputy Registrar Faith Muguongo directed that Aden be taken to Kenyatta National Hospital.
