How CS Matiang’i Used City Law Firm To Launder Ruaraka Land Scam Proceeds

Money laundering is a widespread problem plaguing even well-functioning, developed countries. To portray how much of an issue money laundering is globally,the International Monetary Fund on February 11 2019 estimated the annual amount of “dirty money” laundered worldwide is about $800 billion to $2 trillion US dollars or the equivalent of 2 to 5% of global GDP .

Kenyans lost billions of shillings after the National Lands Commission misled the Education ministry to release Sh1.5 billion for land in Ruaraka which was already public property.Multiple sources have told Mahakamani News that the proceeds of the land scam was chanelled to a city law firm, Nyaundi and Tuiyot Advocates, owned and managed by a former electoral commissioner and high court judge, Ken Nyaundi and Francis Tuiyott.

Tuiyott who is a High Court Judge at Nairobi Milimani Commercial Courts Commercial and Tax Division partnered with Nyaundi to form a law firm .Nyaundi returned to practice law after being removed out of the disgraced and defunct Interim Independent Electoral Commission (IIEC) where he served as a commissioner under Isaak Hassan.

On behalf of their client, the Interior and Coordination of National Government Cabinet Secretary Fred Matiang’i , they agreed to receive and secretly engage in illegal money laundering of hundreds of millions he made from the land scam ,then proceeded to “wash” the money .This is according to the Ruaraka Land Scandal investigation file sent by the Ethics and Anti-Corruption Commission (EACC) to the Director of Public Prosecution Noordin Haji in May this year.

Mahakamani News was reliably informed by sources at DPP that orders for Matiang’i’s arrest are due to be issued on Tuesday this week.Surprisingly ,rather than order for the arrest and prosecution of CS Matiang’i along with dozens of other high profile individuals in government ,DPP Noordin Haji sent back the investigation file back to the EACC requesting that the Directorate of Criminal Investigations (DCI) be incorporated into the Ruaraka Land Scandal investigation.

It would later emerge that the DPP decided to backflip and sit on the file for two months and the reason he returned the file to EACC was to give Matiang’i a huge reprieve .According to sources that spoke to Mahakamani News said that during the discreet probe ,EACC investigators had prepared a water-tight case against Matiang’i and his co-suspects including documenting an unmistakable money trail to .

However,strong efforts were made to save and protect Matiang’i .The Director of Criminal Investigations George Kinoti made attempts to influence the investigation to absolve Matiang’i but the evidence collected and Matiang’i’s own self-incrimating statements served to implicate him more.

The DCI finally won in his quest to save the embattled CS Matian’gi after it emerged that the DPP was suddenly prompted by an urgent need to facilitate a reversal of the probe to include him.The law does not point out that corruption cases must be investigated jointly by the DCI and it’s why the EACC had strongly resisted his inclusion as it was meant to use uncouth methods to save Matian’gi.
