Mwendwa released from police custody on bail.

Mwendwa is facing charges of fraud totalling Ksh37 million. However, his defense team has challenged his re-arrest stating that due process was not followed. 

Nick Mwendwa, the suspended boss of Football Kenya Federation (FKF) is set to answer to charges of fraud on Monday, November 29. 

The former FKF president was re-arrested on Friday, November 26, and spent the weekend in police custody

Sources say that Mwendwa is expected to answer two charges of fraud with the first stating that he failed to account for Ksh29.5 million said to be missing from FKF’s accounts. 

In the second account, Mwendwa is supposed to account for Ksh 8.5 million which detectives say was misappropriated. 

However, Mwendwa’s defense team has raised pertinent questions stating that the embattled former FKF boss has not recorded an official statement with police asking which file will be used to arraign him. 

Mwendwa’s case is complicated further as the Director of Public Prosecutions (DPP) says that his office is yet to receive any file in regard to the case. 

In a letter addressed to the Inspector General of Police, Mwendwa’s lawyer Eric Mutua protested against his detention at Gigiri Police Station after he was arrested on Friday while driving along Kiambu road. 

“We shall hold you and all concerned officers individually and or personally liable for the false imprisonment, unlawful confinement, abuse of police powers, abuse of office, and violation of his rights,” the statement by Mwendwa’s lawyers read in part. 

Milimani Magistrate Wandia Nyamu dismissed an application by police who wanted to detain Mwendwa for an additional seven days to conduct investigations after he was arrested on November 12.
