Proposed bill seeks to fine bloggers and whatsapp group administrators

A proposed amendment of the Kenya Information and Communication Act will require all bloggers and whatsapp group administrators in Kenya to register with the Communications Authority.

In the bill that is sponsored by Malava MP Moses Malulu Injendi, bloggers will now be required to apply to Communications Authority for a license. Blogging without license will attract a fine of Ksh. 200,000 or a imprisonment term not exceeding 1 year.

According to the bill, some of the the requirements for licensing of a blogger are: That the blogger should have a physical office in the country; That all users of the social media platform should be registered using legal documents; That the licensee should keep all data of users of its platforms.

According to the bill, a blogger is defined as any person who collects, writes, edits and presents news or news articles on social media platforms or on the internet.

This bill has been labelled by the public as a retrogressive law which is repugnant to the constitution as it aims to repress the fundamental rights as enshrined in the constitution in that it will limit both the freedom of expression and freedom of association.
