Flamboyant Lawyer Donald B. Kipkorir has been retained by controversial blogger Cyprian Nyakundi following the restaurant’s intention to sue the blogger.
ArtCaffe had on 12th April 2021 sent a demand letter to the blogger for posts he made on his social media pages to the effect that ArtCaffe was shutting down.
“BREAKING: ArtCaffe is set to SHUT DOWN its core restaurant business in Kenya following punitive lockdowns initiated by President Uhuru Kenyatta. Approximately 700 Kenyans will be retrenched. Few outlets will be converted to grocery stores. #EndOfAnEra#UnlockOurCountry“, a Twitter fan account of the blogger announced.
“Our instructions are therefore to demand, which we hereby do, that you immediately pull down and delete the said injurious and defamatory tweets and posts on the respective social media platforms and cease forthwith any false publications against our Clients. Our Client has always been available to issue any clarifications regarding any issues touching on it, which you have failed to explore before making the false and defamatory statements”, the demand letter stated.
KTK Advocates, DBK’s law firm had on 13th April 2021 responded denying the blogger had made any comments that are defamatory to the restaurant.
“We have been retained by Cyprian Nyakundi, our Client to act for him herein and pursuant your demand letter dated 12.04.21. Our Client denies in toto your Client’s Claim. Our Client further denies any defamatory meaning to the said publication, and pleads Justification, qualifies privilege and innocent dissemination on internet”, KTK advocates shot back.
Cyprian Nyakundi seeks to further seek to know number of ArtCaffe’s staff as at March 2020, their salaries as of April 2021 and its gross earnings between Fenruary 2019 and March 2020 and also between APril 2020 and March 2021 as per the letter of reference sent by KTK advocates on his behalf.
