Win for Governor Anyang’ Nyong’o as Court of appeal reverses high court ruling

Kisumu County boss, Anyang’ Nyong’o and his sister Risper Nyagoy are reprieved after the Court of Appeal earlier this week halted the execution of orders that had compelled the duo to share their father’s Ksh. 200 million estate with their nephews.

The applicants have been engaged in a prolonged legal battle with their kin over the multi-million shilling estate. They challenged a decision made by High Court judge Hon Justice Thrispisa Cherere on October 11, 2018.

The decision had ordered the applicants to include all children belonging to their two sisters as beneficiaries of their late father’s multi-million shilling property. 

The judgement also revoked the administrative letters and certificate of confirmation that had placed Prof. Nyong’o and Dr. Nyagoy as the sole controllers of the estate. Furthermore, Kenneth Odhiambo Okuthe, one of the nephews,appointment as a co-administrator of the late Hewson Shimei Nyongo’s estate had also been revoked.

The duo had also been ordered to present documents that show they had opened an account for the estate on July 9, 2014.

The three bench judge comprising of Justices Erastus Githinj, Hannah Okwengy and Jamila Mohamed stopped execution of the High Court order that sough to compel the applicants to share their fathers vast estate with their nephews.

Through lawyers, Chacha Odera and Judith Gureswa the applicants had informed the court that the lower court judge had erred in the judgement by granting orders that revoked the administrative certificate for the property even though no application to that effect had been made.

The defendants had sued the duo for leaving some relatives out of the list of beneficiaries of their late grandfather’s estate.
